But the City of Fishers defines the public right-of-way to include public streets, road shoulders, sidewalks and trails, curb ramps, curbs and gutters, and driveway approaches — and on a typical subdivision lot, every route to your backyard crosses at least one of those.
Worth knowing before you get quotes, because it's where estimates quietly differ from each other.
The City's contractor instructions state that a permit is generally not required solely to cross the right-of-way to access a backyard. The guidance is to use the driveway wherever possible, and when crossing grass, sidewalks, or other surfaces, to lay protective material such as plywood to prevent damage. That's the cheap, low-friction case, and it covers most patio jobs where a skid steer can get around the side of the house.
This one is different. Placing a vehicle, truck, lift, or similar equipment within the public right-of-way generally calls for an Indiana business registration, a certificate of insurance, a minimum $2,000 performance bond, and the applicable Right-of-Way Permit. On a backyard patio the ready-mix truck usually cannot get off the street, so this is the requirement most likely to apply to your job — more so than anything about the slab.
A patio needs four inches of compacted #53 stone under it, and on a tight lot that stone often gets dropped at the curb before it's moved to the back. The City notes that a permit and a site drawing may be required when stone or mulch is temporarily placed within the right-of-way — but that contractor registration, insurance, and a performance bond are generally not required solely for that activity. It's a lighter-touch requirement than parking equipment, which is a useful distinction when you're sequencing a job.
Replacing an existing patio means somewhere to put the old slab. Dumpsters and portable storage containers may require a Temporary Use Permit through the City of Fishers Planning and Zoning Department — a different department and a different application than contractor registration or a Right-of-Way Permit. Worth confirming early rather than the morning the container is scheduled.
Many Fishers lots have a public sidewalk between the street and the yard. If equipment damages it, repair or replacement is its own category in the City's instructions — generally requiring an Indiana business registration, a certificate of insurance, a minimum $2,000 performance bond, a Right-of-Way Excavation Permit, and a final inspection. That's why the plywood matters: protecting the sidewalk on the way in is dramatically cheaper than replacing it on the way out.
Most residential patios are a 3–4 day job on site, plus cure time before you use it. The access plan gets settled at the estimate, not on pour day.
Measure the area, confirm slope direction and where water is going to go, and walk the access route. Establish whether a skid steer can get around the house, where the ready-mix truck will sit, and whether a public sidewalk is in the path.
Confirm what your subdivision's architectural review requires and what the job needs on the City side. Right-of-way requirements attach to equipment staging and any sidewalk work, not to the patio slab itself.
Stake the footprint and confirm it against setbacks and the drainage plan. Remove existing slab or sod. Protective material laid over sidewalk and turf on the access route before equipment moves.
Dig to depth for base plus slab. Establish the fall away from the house before any stone goes down — slope is built into the subgrade, not corrected at finish.

Drainage and base. Everything else is finish work. A patio that slopes toward the house drives water at the foundation every time it rains, and no sealer or finish corrects that later. The base is the other half. Four inches of #53 INDOT stone compacted to Standard Proctor density is what keeps the slab from settling differentially once the soil under it goes through a few wet-dry cycles. Cutting the base short is invisible on handover day and obvious in year three, when one corner has dropped and the control joints have opened.
The load isn't the reason. Indiana's freeze-thaw cycling is. A 4000 PSI air-entrained mix has the entrained air void structure that lets the paste absorb freeze expansion without spalling — the surface damage you see on older patios where the top layer flakes away. A weaker mix would carry patio furniture fine and still fail at the surface within a decade of Hamilton County winters.
Rear-yard access is the constraint that shapes most Fishers patio quotes. Subdivision lots built from the 1990s onward tend to be deep rather than wide, with limited side-yard clearance between houses and privacy fencing already in place. Whether a skid steer fits down the side of the house — or whether the crew is wheelbarrowing concrete from a truck at the curb — changes the labor on the job substantially. It's worth asking any contractor how they plan to get material to the back before comparing prices, because two quotes that look different are often quoting two different access methods.
HOA architectural review runs on its own calendar. Many Fishers subdivisions require approval for hardscape additions, and the association's review schedule has nothing to do with the City's. The two tracks don't wait for each other, so starting both at once is usually the difference between pouring this season and next.
Drainage has a neighbor dimension on tight lots. Sloping water away from your foundation is non-negotiable, but on a narrow lot the obvious direction to send it can be toward a neighbor's yard. Establishing where water actually ends up — not just that it leaves your slab — is part of the layout conversation, and it's easier to solve with grading and a drain before the pour than with a complaint afterward.
Season affects the finish, not just the schedule. Indiana's 25-plus freeze-thaw cycles per winter are exactly what the air-entrained mix is designed for, but a late-season pour still needs protection — we use curing blankets when ambient temperature drops below 40°F. A patio poured in a cold snap without them cures weaker at the surface, and that shows up as spalling years later rather than immediately.
