01 · ROW Permits

Right-of-Way Excavation Permits in Anderson.

Any concrete work that touches or crosses the City of Anderson's Right-of-Way requires a ROW Excavation Permit from the City of Anderson Engineering Department. This applies to:

  • Driveway aprons — the section of driveway between the sidewalk and the street
  • New curb cuts or modifications to existing curb cuts
  • Culvert installations on city-maintained roads
  • Any excavation within the ROW for drainage or utility work tied to a concrete project

The ROW permit requires a drawing showing the project dimensions and location, a description of the work, and proof of contractor insurance. Permit fees vary by project scope. The City of Anderson typically reviews and approves residential ROW permits within 5–10 business days.

Madison County building permits for concrete work.

Structural concrete flatwork — including new driveways, garage floor slabs, and additions to existing structures — typically requires a building permit from the Madison County Building Department. A separate permit from the City of Anderson's building inspection office may be required for work within city limits.

Building permit requirements for concrete flatwork in Indiana vary by project type and jurisdiction. General guidelines:

  • Driveway replacement (same footprint): typically does not require a building permit if the ROW apron is not being modified
  • New driveway on a previously unpaved site: building permit usually required
  • Garage floor slab (new construction): building permit required
  • Patio slab (freestanding, not attached to structure): typically does not require a building permit in residential zones
  • Foundation-adjacent slabs or footings: building permit and inspection required

03 · Rural Access

Culverts, county roads, and rural driveway access.

Properties on rural county roads outside the city of Anderson have a different permit chain than in-city projects. The City of Anderson Engineering Department has no jurisdiction on county roads — instead, permits go through the Madison County Highway Department.

For a rural driveway apron on a county-maintained road:

  1. A driveway access permit from the Madison County Highway Department is required before any concrete work begins at the road connection
  2. If a drainage ditch runs along the road, a culvert installation is required under the apron — sized to county drainage design standards
  3. The culvert permit and the driveway permit are typically issued together by the Madison County Highway Department

For state route (SR-9, SR-38, SR-32) driveway connections, an INDOT Driveway Access Permit from the Greenfield District is required before any new connection or modification. Permits in Fishers, Carmel, Noblesville, and Westfield.

We serve Hamilton County as well as Madison County. Each Hamilton County city has its own permitting system:

  • Fishers: Activity Permit through the City of Fishers online portal. Required for most exterior concrete work including driveways, aprons, and patios near the ROW.
  • Carmel: Consent to Encroach agreement plus a ROW permit from City of Carmel Engineering. The city also enforces a 20-foot maximum driveway width at the ROW.
  • Noblesville: Hamilton County Building Department for residential work. City of Noblesville Engineering for ROW and city-infrastructure work.
  • Westfield: WeConnect online portal for most residential and commercial concrete permits. Washington Township for unincorporated areas just outside city limits.

Common permit questions.

Do I need a permit to replace my existing driveway?
In Anderson: if the work touches the apron (the section between sidewalk and street), a ROW Excavation Permit is required. If you're replacing the full driveway in the same footprint without modifying the apron, a building permit is typically not required. We verify on the estimate visit.
How long do permits take to approve in Anderson?
City of Anderson ROW permits typically take 5–10 business days. Madison County building permits vary by project complexity. We submit permits as early as possible in the project schedule so the approval doesn't delay your pour date.
What happens if I pour concrete without a permit?
